User suspension: JPMMILITARY

Members of the USMF Community:

Today the administration was forced to suspend the account of community member: JPMMILITARY

The following information is being provided to illustrate the basis of this member's suspension so that anyone later dealing with this person may understand the true nature of this person's deception.

Initially, JPMMILITARY purchased an unpublished manuscript / book titled "First Century of American History." It was written by Confederate Civil War soldier Armistead Lindsay Long (aka A.L. Long). The item was sold as Lot #259 at Muscarelli Auction Company for $675.00 on Monday, May 25, 2015.

On May 26, 2015 at 3:05 p.m. (server time), member JPMMILITARY posted a FOR SALE ad titled Unpublished Manuscript "First Century of American History" By A.L. Long. Here is the quick link to the original FOR SALE ad (which was moved in order to preserve it following the contractual issue):

The ad included a picture of the manuscript from sale, which ultimately turned out to be a picture from the auction in which JPMMILITARY originally purchased the manuscript. JPMMILITARY clearly asked for "3k shipping and insurance included" and indicated he preferred PayPal payment. (NOTE: JPMMILITARY only purchased the manuscript for $675 so at this price that is $2325 profit before any PayPal fees.)

At 3:06 p.m., additional pictures from the previous auction were added to the thread. Over 30 minutes later, at 3:30 p.m., JPMMILITARY added additional simple information about the manuscript likely in an effort to bump the ad back up to the top.

Again, at 3:44 p.m., JPMMILITARY bumps the thread up. This clearly illustrates how JPMMILITARY was reading and watching the thread carefully.

At 3:53 p.m., user JayHawker353 indicated acceptance of the seller's offer saying "I'll take it. PM Sent." And, JayHawker353 immediately sent a private message (PM) through the USMF board to JPMMILITARY reaffirming his acceptance to purchase and regarding email information for a PayPal payment.

JayHawker353's post and messages were acknowledged when JPMMILITARY updated the thread (at 3:56 p.m.) with "sale pending".

Moments later, JPMMILITARY responds to JayHawker353 with his email information in order to send the money via PayPal. However, JPMMILITARY attempts to induce JayHawker353 to commit fraud against PayPal by asking that JayHawker353 lie and say the payment is a gift. JPMMILITARY even mentions this lie is to save him PayPal fees. JayHawker353 refuses to lie to PayPal, as it is clear such falsities would be result in the transaction being voided by PayPal and JayHawker353's account being suspended by PayPal.

At some unknown point, it appears that JPMMILITARY got greedy and decided to back out of the contact he had already made to sell the manuscript. JPMMILITARY initially lied claiming that the price of "3k" was incorrect as it should be $30,000. The words from his private conversation with JayHawker353 (which were forwarded along to Administrators) was that he would have to back out because "I may have had the pricing very incorrect."

Cleary, JPMMILITARY already had a contract with member JayHawker353 so this is entirely too late. And, it is a belief of the Administrators reviewing the case that this is further lying on JPMMILITARY's part just like the PayPal fraud attempt. Why is it likely a lie? JPMMILITARY was actively reviewing and participating on his FOR SALE ad so had plenty of opportunity in the 30+ minutes it was available to notice and correct any errors with the ad. He even quoted his original post (which included the price) later in his ad, which again shows he was reading the thread. Also, an Administrator noticed that JPMMILITARY had listed the very same manuscript for sale on eBay for $3,999. Again, he had plenty of time to see the price and change accordingly. The fact he never changed the price in either the eBay auction or the USMF FOR SALE ad clearly indicates that his intent was to sell the piece in the $3,000 range and NOT $30,000.

The Administration was notified of the issue and immediately suspended JPMMILITARY's rights to the FOR SALE section. JPMMILITARY was also informed via private message on May 26, 2015 at 8:40 p.m. (server time) that he had a contract and needed to fulfill that contract or else he would face a public banning.

JPMMILITARY began to follow through with the transaction. JayHawker353 sent payment via PayPal and even, in good faith, sent extra to cover the PayPal fees. JPMMILITARY said he would talk to the estate about modifying the release so that the release would be to JayHawker353 instead of JPMMILITARY (who it was originally made out to).

On May 27, 2015 at 8:48 p.m., JPMMILITARY said that he had received PayPal and would ship the item on the morning of May 28. JPMMILITARY also asked that his account be unsuspended. (It should be noted he was also attempting to sell a medal via our free ads for $2,500 so was very interested in getting his rights back.)

JPMMILITARY was notified that his ability to access the FOR SALE section ads would not be restored. It is the standard USMF policy that, when a member has been shady in their dealings via our board to the point that the USMF Administration has to get involved, it is unfair to other members to allow that shady member back in to the FOR SALE section. Selling in the FOR SALE section is a privilege but not a right.

JPMMILITARY whined about the unfairness. But, ultimately when he realized his FOR SALE access would not be restored so he could post free ads, JPMMILITARY again backed out of the transaction. JPMMILITARY refunded JayHawker353's payment via PayPal and ceased contact.

A lawsuit is now likely going to be filed to enforce the contract.

On the Administration's end, we have permanently banned the member as per our rules and issued this public banning to warn additional members should they deal with JPMMILITARY either on this board or elsewhere in the collecting community.

The FOR SALE section is provided for members as an easy way to sell among friends, since all of us here in this community are friends. For us to maintain that friendly atmosphere, we must make sure that members are fulfilling their obligations. Buyers are buying what they agreed to buy, and sellers are selling what they agreed to sell for the price they agreed to sell.

It is true that the FOR SALE section is operated under the principle that all transactions are between the buyer and the seller. The forum and/or its owners cannot force anyone to complete their obligations nor can we be held responsible for the actions for either party during the transaction or before or after. However, we will (as evidenced here) take action if necessary when there are abuses.
