WARNINGS

 

RULE 1.0 - Modifying/Updating Code of Conduct

 

USMF reserves the right to modify and/or update the Code of Conduct. Warnings, suspensions, and bannings for violations will be governed by the Code of Conduct version in effect at the time of the violation.

 

POSTING

 

RULE 2.0 - General Policy

 

All members are encouraged to be on their very best behavior and use good etiquette in all of their communications at USMF. Childish behavior is strongly discouraged; at all times, members are expected to behave in an adult-like manner. Members failing to use proper etiquette could be permanently banned.

 

RULE 2.1 - Hijacking

 

Every member is encouraged to post information (including pictures of items in the member's personal collection) to aid other members or to demonstrate variations. However, members should refrain from making posts that "hijack" (i.e. taking over or redirect) someone else's thread for the sole purpose of promoting, selling, trading, bragging, showing off, etc. the member's own items.

 

RULE 2.2 - Fighting

 

Not everything is black and white, so disagreements happen. In fact, here at USMF disagreements and discussions regarding these disagreements are encouraged. Some of the most valuable information can be gained in threads where various members disagree about a point and post information supporting their point of view. However, members who disagree and, in an effort to support their point of view, turn to personal attacks or other inappropriate behavior run the risk of being temporarily suspended or even banned.

 

RULE 2.3 - Discrimination

 

USMF does NOT tolerate any form of discrimination. Any posts violating this provision are subject to immediate deletion. Additionally, members being reported for a violation are subject to being permanently banned. [See Rule 2.3(f) for the historical exception to this rule.]

 

RULE 2.3(a) - Racism

 

USMF does NOT tolerate any members making inappropriate communications (including posts and private messages) disparaging any race.

 

RULE 2.3 - Nationalism

 

USMF does NOT tolerate any members making inappropriate communications (including posts and private messages) disparaging any nation.

 

RULE 2.3[c] - Religion

 

USMF does NOT tolerate any members making inappropriate communications (including posts and private messages) disparaging any recognized religion.

 

RULE 2.3(d) - Gender

 

USMF does NOT tolerate any members making inappropriate sexist comments or innuendo (including posts and private messages) that are disparaging, degrading or insulting to either gender. This also applies to the use of links to other websites in which photos or text are used in a similar manner."

 

RULE 2.3(e) - Homosexuality

 

USMF does NOT tolerate any members making inappropriate communications (including posts and private messages) disparaging one's sexual orientation.

 

RULE 2.3(f) - Exception

 

The USMF Administration recognizes that cultures and traditions change over time. Thus, USMF allows a historical exception to the rule of discrimination. The communication of or discussion about historical documents, items, information, etc. involving past culture and social mores (i.e. social traditions) may be deemed acceptable even though it may go against modern social traditions about the subject.

 

Politics

RULE 2.3(g) - USMF strongly discourages making inappropriate communications (including posts and private messages)that are overtly political or ideological (strong opinions on social, economic or political systems) in nature. Such discussions rarely achieve positive results and tend to override the intended topic of discussion. No political comments or discussions, and any posted may be removed at the discretion of the USMF staff.

 

RULE 2.4 - Disclaimer

 

USMF's owners and operators and not as a whole nor personally liable for any inappropriate communications (including posts, private messages, and/or e-mails) made by its members.

 

 RULE 2.5 - Account Limit

 

Each member is limited to registering no more than one account. If the owners and operators of USMF find that a member has registered, or attempted to register, more than one account, that account is subject to removal and the members may face suspension and or banning. By registering on USMF you agree not to hold more than one account. If someone is banned for any reason and it is discovered that they have created another account with different information, that account is subject to immediate banning. Once banned, someone may not join under another name.

 

 

PRIVATE MESSAGING

 

RULE 3.0 - General Policy

 

Sending private messages to other community members via a USMF private message (or "PM") link on the board or member's profile page and using the USMF private message system is a privilege and not a right. Members are expected to act appropriate and adult like in their communications. Also, members are strongly encouraged to keep private messaging through USMF to a minimum, as some community members may feel the unsolicited contact is offensive.

 

RULE 3.1 - Implied Consent

 

All community members (except those on administrative probation) have access to the private message system, which allows community members to send private messages to other members and receive messages from members. USMF does not monitor communications within this private message system. Any communication (including passing of personal information or forwarding of another member's personal information) that a user provides through the system is the sole responsibility of that member. USMF is not to be held responsible nor liable for any issues that may result.

 

RULE 3.2 - Unsolicited PMs

 

USMF cannot possibility prevent unsolicited PMs being sent through the USMF private message system. However, members are encouraged to report suspicious unsolicited private messages to USMF Administration so that action can be taken immediately.

 

RULE 3.3 - Violations

 

If it comes to the USMF Administration's knowledge that a community member is using the USMF to send unsolicited private messages, particularly private messages purporting to sell items, the community member sending these private messages could be subject to having his or her account permanently banned.

 

 

 

E-MAILING

 

RULE 4.0 - General Policy

 

Sending e-mails to other community members via a USMF e-mail link on the board or member's profile page is a privilege and not a right. Members are expected to act appropriate and adult like in their communications. Also, members are strongly encouraged to keep e-mailing through USMF to a minimum, as some community members may feel the unsolicited contact is offensive.

 

RULE 4.1 - Implied Consent

 

Any member making their e-mail address available in any part of the USMF board (including posts, private messages, signatures, e-mails to other members through the board, etc.) openly accepts the risk that his or her e-mail may be obtained by a third party who was not originally intended to have knowledge of the member's e-mail address. USMF is not responsible for any communications, including spam and viruses, that may result.

 

RULE 4.2 - Unsolicited E-mails

 

USMF cannot possibility prevent all unsolicited e-mails being sent through the USMF e-mail forwarding. The USMF Administration strongly encourages members to report all suspicious (as detailed below in Rule 4.3) unsolicited e-mails to USMF Administration so that action can be taken immediately.

 

RULE 4.3 - Violations

 

If it comes to the USMF Administration's knowledge that a community member is using the USMF to send unsolicited e-mails, such as e-mails purporting to sell items, direct the receiver to a third party website or forum, to harass and/or to threaten the member, the offending community member sending these e-mails could be subject to having his or her account permanently banned. These types of emails could also be considered in the same context of SPAM.

 

 

 

SPAM

 

RULE 5.0 - Definition

 

Spam is an issue of consent and not content. Whether the communication is an advertisement, scam, friendly letter, or an offer for free militaria, the content is irrelevant. If the communication was unsolicited and in bulk then the message is spam.

 

RULE 5.1 - General Policy

 

USMF does not in any way support or promote the posting, private messaging, e-mailing, and/or any other method of communicating of spam to or among USMF community members. In short, do NOT do it.

 

RULE 5.2 - Penalty

 

Any member found in violation of the USMF policy against spam is subject to having their account banned.

 

RULE 5.3 - Exceptions

 

This USMF policy does not apply to bulk communications from the USMF Administration to community members. By becoming members and using USMF, all community members have given implied consent to received communications by the USMF Administration.

 

 

 

PRIVACY

 

RULE 6.0 - Privacy Policy

 

US Militaria Forums makes every effort to guard member privacy. We do NOT sell, share, or trade personal member information. (Please see exceptions under Rule 6.2 and Rule 6.3.)

 

RULE 6.1 - Spyware

 

US Militaria Forums, unlike many other online forums, values your privacy. We do NOT and will NOT use any form of “spy” software in order monitor, read, edit, or send any community member’s private messages or e-mails. (Please see exceptions under Rule 6.2.)

 

RULE 6.2 - Privacy Exceptions

 

Any information a member provides openly on the board (via a post, private message, or through board email), to a third party, on a third party website (such as Facebook or MySpace), or in any other similar way is subject to use by the US Militaria Forum, especially if the member's membership is revoked, banned, suspended, or limited.

 

RULE 6.3 - Law Enforcement

 

US Militaria Forum will provide all known member information when requested by a law enforcement agency or court. And, if a member behaves inappropriately, US Militaria Forum reserves the right (and in many cases is required) to report that member's information to the appropriate law enforcement agency.

 

RULE 7.0

OTHER FORUMS

 

RULE 8.0 - Acceptable Posting

 

US Militaria Forum recognizes that many community members belong to multiple other militaria sites. USMF in no way bars or penalizes its members for membership with any other online forums.

 

RULE 8.1 - Unacceptable Posting

 

No place is perfect. Here at USMF we like to keep our atmosphere friendly and adult-like.

 

Consequently, members are strongly encouraged to refrain from badmouthing, bashing, or name-calling regarding other online forums. We do not have a problem with a member stating: "I have had some problems with X forum." However, we wish for members to keep their negative discussion of other forums to a minimum, particularly discussions of any in-fighting or personal issues with the other forum's members and/or owners.

 

USMF reserves the right to delete or edit all posts that violate this provision.

 

 

 

PORNOGRAPHY

 

RULE 9.0 - Pornography Policy

 

Posting any type of pornography, including “soft porn” is strictly prohibited on the US Militaria Forum board. USMF actively monitors for such content and will not only immediately remove once it is found, but USMF will assess warning points against the member.

 

RULE 9.1 - Penalties

 

Members posting pornography (not including child pornography) can expect at least the following penalties:

 

(a)VIOLATIONS BY MEMBERS WITH NO VALID POSTS:

 

Members posting pornography as their first post will automatically have their account banned. Users who have previous posts evidencing some desire at forum participation yet failing to provide any research, historical, and/or experienced collector or historian insight will have their account suspended for at least one week. If within the year following the removal of the suspension, the member again posts pornography, the member’s account will be immediately banned.

 

(b)VIOLATIONS BY MEMBERS WITH VALID POSTS:

 

Members with at least one valid post in their post history will be subject to a 25 point warning for the first time violation. The 25 point warning will expire 6 months after the initial violation.

 

If the member violates the USMF “No Pornography Rule” for a second time within 6 months of the first violation, the member will be assessed 50 warning points. The addition of these points will stop the initial first-time violation warning from expiring. Instead, the total of 75 warning points will expire in sections: 25 points will expire in one year from the day of the second violation and 50 points a year and a half from the day of the second violation.

 

If any member violates the “No Pornography Rule” three times within the year will immediately be banned from USMF.

 

Depending on the nature of the infraction, USMF does reserve the right to immediately suspend and/or ban any member posting pornography.

 

RULE 9.2 - Child Pornography

 

USMF will immediately delete not only the member’s post containing the child pornography, but the member’s account will be immediately and permanently banned.

 

The USMF has a legal, as well as a moral obligation to report the violating member’s information to the appropriate authorities for investigation and possible criminal charges. Furthermore, we will cooperate fully with these authorities.

 

 

 

FOR SALE SECTION (WHEN AVAILABLE)

 

RULE 10.0 - Age Requirement

 

All members must be at least 18 years of age in order to use the FOR SALE, TRADE, and WANTED sections (When Available). US Militaria Forum's administrators reserve the right to suspend and/or revoke any member's privileges within these sections in the event the member is believed to be under 18 years of age.

 

RULE 10.1 - Posting Requirement

 

Each member must have at least 30 SUBSTANTIVE posts before the system will allow the member to post an ad in the FOR SALE, TRADE, and WANTED sections (no one or two word posts such as "That's great," etc.). The granting of use permissions is automatically done by the system. So, as soon as the 30th post is made, permission will be granted and the member may post his / her ads. Posts that appear to have been done solely to boost the post count as fast as possible will not be counted.

 

This posting rule does not apply to buying through ads. All members in good standing, regardless of the number of posts, can respond to sellers via PM and purchase items.

 

RULE 10.2 - General Ad Rules

 

Sellers must have the item in hand at time of sale. No third-party sales are allowed. 

 

A key factor in our FOR SALE section is that the SELLER is responsible for accurately describing and promptly shipping or delivering the purchased item. If the buyer does not receive an item they paid for the seller must provide a refund. Sellers are advised to use shipping methods that include proof of delivery.

 

Items posted in the FOR SALE section MUST contain (1) a general description of and/or a picture of the ACTUAL item for sale and (2) the price you are asking for the item. Other forum members may not make negative comments about the pricing of an item or the FOR SALE listing in general, but if you believe an item is falsely or inaccurately represented, please contact a moderator or direct your comments to the poster through the PM messaging system.

 

RULE 10.2(a) - Pricing, payment & shipment

 

It is prefered that all FOR SALE ads be listed in US Dollars only. However, it is not against the rules to include a foreign currency price within the add. If you chose to do so, the foreign price MUST be accompanied by a price quoted in US Dollars. We understand that an exact translation is not possible when converting the foreign price to the price in US Dollars. However, we ask that you please include a close approximate. You may not require that buyers pay as PayPal "gift" as this limits buyers ability to seek PayPal refunds if the transaction goes wrong. Any ad requiring using the PayPal gift option will be deleted. Also buyers should not ask sellers to list a purchase as a "gift" or lie about the value on official custom forms as this requires a seller to commit perjury. NOTE: If seller has a policy restricting shipment to US, Europe, etc. please include what country or countries you will ship to in your ad. If you will only ship to the US then include that in your listing.

 

RULE 10.2 - Auctioning

 

There will be NO auctioning.

 

RULE 10.2[c] - "Best Offer" Phrases

 

The use of the statements "best offer," "price on request", or similar phrases is acceptable as long as those phrases are accompanied by a stated price. For example, "$80 OBO" ($80 or best offer) is acceptable but "OBO / Or Best Offer" without a price is not.

 

RULE 10.2(d) - Lists of Items

 

If you have a list of items for sale, please post that list on the board and do NOT post a Word or Corel document for users to download.

 

RULE 10.2(e) - Outside Links to Websites

 

In this section, we do not allow the posting of general links to outside websites for additional pictures or where other militaria, not listed on this site, is for sale. This feature is for the protection of our members. Without this restriction here, some users would abuse this by posting innocent looking links to viruses or inappropriate content. Additionally, in the case of fraud, modify or remove item pictures on the outside website.

 

RULE 10.2(e) - THIS SECTION INTENTIONALLY LEFT BLANK

 

RULE 10.2(f) - Medal of Honor

 

There will be NO buying, selling, and/or trading of the Medal of Honor, which includes the medal, ribbon, button, and/or rosette. NO EXCEPTIONS

 

US Militaria Forum is hosted by a US company and its owners are located in the US. Therefore, we are fully governed by the laws of the United States. Under Title 18 United States Code Sec. 1001 (another section deals with buying), it is basically illegal to buy, sell, and/or trade the Medal of Honor medal, ribbon, button, or rosette. The law is broad enough that, although you are the one listing the item for trade, the government may subject even the venue (i.e. USMF) and its owners to both fines and jail time. For obvious reasons, we do not wish to take such a risk. Thus, all For Sale ads attempting to buy, sell, and/or trade the medal, ribbon, button, and/or rosette will be immediately removed and the user may be subject to a warning for a For Sale Section rule violation.

RULE 10.2(g) - Selling Modern Firearms and Ammunition

 

We do not allow selling of post-1897 firearms or live ammunition on the US Militaria Forum.  Pre-1897 weapons are allowed to be sold, as well as accessories for modern firearms, but no auto conversion kits.

 

 RULE 10.3 - Sellers Backing Out

 

Once a written contract is made (email and PM's count as a writing), we strongly encourage sellers to follow through with the transaction. If not, sellers could subject themselves not only to penalties via the USMF board, but also civil and criminal penalties in their state.

 

 RULE 10.3(a) - Sellers

 

Using the FOR SALE section for free "for sale" ads is a privilege of our membership and NOT a right. Sellers backing out of transactions will be subject to punishment, including (but not limited to) removal of all of the seller's current FOR SALE listings.

 

Remember, backing out of deals makes not only the seller look bad, but reflects poorly on the board and its owners. It also breeds lots of distrust among members. Therefore, we at USMF take such issues very seriously.

 

RULE 10.3 - Buyers

 

USMF cannot force members to complete transactions. Where a seller has backed out of a transaction after a sale contract has been made, we request that you please send the USMF Administration or the For Sale Section Moderator notification of the issue.

 

If there is sufficient evidence to illustrate that a buyer has in fact backed out of a deal after there was a contract, the buyer will be subject to punishment, including (but not limited to) removal of all Buying/Selling/Trading rights on USMF.

  

RULE 10.3[c] - Exceptions

 

Please be aware this section does not apply to incidents where the buyer has contracted to purchase an item and then fails to deliver payment in the manner and/or time specifically stated within the original buyer-seller agreement.

  

RULE 10.4 - Buyers Backing Out

 

Once a written contract is made (email and PM's count as a writing), we strongly encourage buyers to follow through with the transaction. If not, buyers could subject themselves not only to penalties via the USMF board, but also civil and criminal penalties in their state.

 

 RULE 10.4(a) - Sellers

 

USMF cannot force members to complete transactions. Where a buyer has backed out of a transaction after a sale contract has been made, we request that you please send the USMF Administration or the appropriate FOR SALE, TRADE, and WANTED section moderator notification of the issue.

 

If there is sufficient evidence to illustrate that a buyer has in fact backed out of a deal after there was a contract, the buyer will be subject to punishment, including (but not limited to) removal of all privileges within the FOR SALE, TRADE, and WANTED sections.

 

RULE 10.4 - Buyers

 

Buyers are encouraged to follow through with all transactions in a prompt and courteous manner according to their agreement with the seller.

 

Remember, backing out of deals makes not only the buyer look bad, but reflects poorly on the board and its owners. It also breeds lots of distrust among members. Therefore, we at USMF take such issues very seriously.

  

RULE 10.4(a) - Exceptions

 

Please be aware this section does not apply to incidents where the seller has contracted to purchase an item and then fails to deliver the item in the manner and/or time specifically stated within the original buyer-seller agreement.

  

RULE 10.5 - Sold Items

 

Upon notification via at least one of the following two methods, the FOR SALE section moderator will then move the sold item to the SOLD ITEMS subforum. This way, only unsold items will remain in the FOR SALE section.

 

RULE 10.6 - Penalties

 

Generally, there are no penalties associated with violations of the FOR SALE section rules. However, depending on the nature of the infraction and/or the user's history of violations, USMF does reserve the right to immediately suspend and/or ban any member posting in violation of this section.

 

RULE 10.7 - Ad Expiration

 

Ads are available for at least 30 days. USMF has a function set to automatically delete all For Sale ads that have not received any posts in the last 30 days. If a member's item has not sold and/or the member's ad is deleted due to no posts in 30 days, the member is certainly free to repost a For Sale ad for the item.

 

This feature does not affect items in the SOLD ITEMS section, as those are held indefinitely as reference in that section. It also does not affect the FEEDBACK section.

 

RULE 10.8 - Excessive Ads

 

We recommend and strongly encourage members to keep their FOR SALE, TRADE, and WANTED posts to perhaps four to six per week. While this is generally a self-enforcing, honor system policy, we reserve the right to warn or revoke FOR SALE, TRADE, and/or WANTED section or MEMBERSHIP privileges for anyone who makes what we deem to be excessive use of this section. And, we will also do such reviews for members who use only the FOR SALE, TRADE, and WANTED sections and do not contribute to the main sections of the forum.

No more than 10 (ten) ads per member at any one time. The USMF owner and administration reserves the right to remove any ad for any reason at their discretion with no prior warning.

Remember, the FOR SALE, TRADE, and WANTED sections are a convenience for forum members and not a place for free hosting of your large militaria store.

 

RULE 10.8(A) - Excessive "Bumping" of Ads

 

We strongly encourage members to allow for a minimum of 72 hours (three days) prior to "bumping" a post, or making price reductions. If the administrators and/or moderators of USMF feel this rule has been violated, offending threads may be locked or edited.

 

 

RULE 11.0 - THIS SECTION INTENTIONALLY LEFT BLANK

If a member's item has not been traded and/or a member's ad is deleted due to no posts in 30 days, the member is certainly free to repost the item for trade.

 

This feature does not affect items in the SOLD ITEMS section, as those are held indefinitely as reference in that section. It also does not affect the FEEDBACK section.

 

RULE 11.4

WANTED SECTION

 

RULE 12.0 - General Rules

 

USMF members can post any military or military related items they are looking for or wanting, as long as the items do not violate Rule 7.0 and 7.1. [See Rules 7.0 and 7.1 for more information.] Also see rule 10.8A under FOR SALE for rules about updating or 'bumping' a post.

"WHAT'S IT WORTH" FORUM

 

13.0 - GENERAL RULES AND GUIDELINES

 

THE USMF IS NOT RESPONSIBLE FOR ANY OF THE APPRAISALS OR PRICES THAT ARE POSTED.

 

Prices on militaria items are subjective and can vary greatly based on the item, condition, date of manufacture and documentation.

 

Members may differ in their appraisals based on experience and collecting interests. Extended debates over which prices are correct are not encouraged as opinons will differ.

And, by signing up for a membership, all members agree that, in the event their accounts should be banned or suspended, these bannings and suspensions may be (and normally will be) made public.

Anyone making a post agrees that the information in that post will remain posted in perpetuity, at the Forum's discretion.
