Can anyone positively I.d this as a 71st national guard medical shako as it is being labeled a cw era. But it looks newer.

It's post Civil War. Probably late 19th century. New York National Guard.

Yup, probably c. 1880. 71st Infantry Regiment New York National Guard. Nice kepi, fairly uncommon. I have seen the uniform coats from this unit much more often.
