I'd bet museums get a pass, but they'd be donated as the item wouldn't have monetary value... It would absolutely drive sales overseas, just as it has with the CMOH.

Here is what I wrote:

 

Senator,
I wanted to direct your attention to S.R.765 which is currently in the Committee of the Judiciary. The resolution would make any Purple Heart issued to an individual illegal to buy sell or trade. I ask that you oppose this bad legislation at your soonest opportunity. The bill would make the estimated 1.5 million issued Purple Hearts impossible to preserve as they would become "toxic". This same thing happened to the Medal of Honor as part of the Stolen Valor Act where the vast majority of them were sent overseas and are now in hands of collectors around the world from China to Germany. We exported our heritage over a misguided attempt a patriotism.
The premise behind the bill is that all Purple Hearts belong to the the individuals and their families and not "strangers." What it doesn't address is the fact that for many of the Purple Hearts out there, there is no family for them to go to or the family themselves sold the medal on. As a retired USAF MSgt and collector, I am charged with the preservation of the medals under my care. If you make them illegal to transfer, many Purple hearts out there will simply be thrown away. That is an abomination to the legacy of those who earned them.
I would be really happy to meet with you with examples of Purple Hearts in my collection where a family does not exist or the family voluntarily gave them up. PLEASE consider opposing this well intentioned, but poorly researched bill... Thank you!

I finally got a reply today from my RI rep Cicilline. He thanked me for supporting HR 544. Clearly he did not read the two emails I sent him explicitly detailed why he should NOT support this. I will be relpying to him tomorrow expressing my disappointment and disbelief. His reply reads as more of a resume of his achievements for veterans.

 

How do you compose a letter for one who does not read?

Prohibition only works when there are clear guidelines from the start. As they say the cats already out of the bag. Just as alcohol had been around for thousands of years, there are 2 million Purple Hearts already out in the wild. How do they expect to get them under control?

WM, that's like talking to a wall. Wise doesn't equal cunning. They are only motivated by keeping their congressional seats and to that end, whatever they see as delivering the most safe, sure votes for their next re-elections, even if it means disregarding established legal principles, like the right to own private property. "Great lawmakers". Like hiring foxes to pluck chickens. Think about the MOH "prohibition". I submit it is UNPARALLELED in American law. I challenge anybody reading to name one other tangible personal property item that has ever been illegal to sell in 241 years that is not ACTUAL stolen property, inherently dangerous, unsafe or has a body of science supporting the assertion it presents health risks.

 

It's really unfortunate that nobody mounted a challenge to the MOH prohibition as being unconstitutional when that was rammed through years ago. As Edmund Burke supposedly said in the 18th century, “The only thing necessary for the triumph of evil was that good men should do nothing.”

 

What is being pulled now is another destination downhill on that slippery slope. And after they jam this through with little or no opposition in Congress, if you think that's the terminus of the slippery road, you're dreaming. I predict this gutless attack on liberty will become the law of the land and will only be shot down by someone filing a constitutional challenge down the road that makes it all the way to SCOTUS. Simply because the politicians are in full, safe herd mode. They are widely criticized for getting little meaningful legislation passed-- so window dressing like this (for most people, other than collectors and historians) is right up their alley. A "feel good", meaningless prohibition that will not better the lives of any Americans, but something they can toot their horns about. It will be amazing if more than a handful out of 535 will have the integrity or courage to stand up against this mess when it comes to debate and voting on it.

 

If they think that permitting the original recipient or families to sell a PH, but then forbid any future legal transactions to bona fide purchasers for value, does not economically harm the property right of the original recipient/family they are either stupid or liars or both. It goes without saying that the economic value of anything is depressed if you can buy it once but never sell it.

Well, my Congressman... Richard Hudson , took the time and effort to come to my store today.He was very attentive and spent about a hour in the discussion concerning HR 544...while he didn't say what his side he would side...I am sure he definitely got new insights about the misconception of the bill and it's necessity. We shall see..

Just sent this to my senator...

 

Dear Senator,

 

It has come to my attention that you are serving on the Senate Committee of the Judiciary for S.R. 765, AKA the Private Corrado Piccoli Purple Heart Preservation Act.

 

The goal of the bill is, as I’m sure you know, to make buying/selling/trading the Purple Heart medal or ribbon illegal. However, it does a LOT more harm than good. One of the main proponents of the bill is that collectors are "evil" and only care about making a profit off of selling the medals, and that collectors do not appreciate Purple Hearts. Another thing that they claim is that most medals were stolen or "lost". These accusations are not even close to being true. This is a pointless, "feel good" law that will have disastrous consequences if it passes.

 

I am only 16, but I own 2 Purple Heart medals, and 5 Purple Heart ribbons. One medal and one ribbon are from local vets from my hometown of Not telling the forum (i sent him the actual city though), Nebraska. Both are USMC items, belonging to different vets. I purchased these items from my local pawnshop, where they had been sitting collecting dust for years. The Purple Heart ribbon has 2 stars on it (indicating he was Wounded In Action three times in combat) and the bar has other ribbons. The owner of the pawnshop told me that the vet sold his military stuff a few years ago, since he was dying from cancer caused by Agent Orange and had no family. Today, it is on display in my collection. I will never know the mans name, but I am ever grateful for his sacrifice. It is an incredible experience holding a Purple Heart in your hands and thinking about all the vet sacrificed for our country. I have purchased uniforms and groupings online that include Purple Heart ribbons, and I always take the time to research and display the items proudly.

 

I have never met or heard of a collector who disrespected a purple heart, or has ever flipped one solely for profit. More often than not a collector takes much better care of Purple Hearts than families do. Collectors research, display, and share Purple Hearts and their stories while if it was in a family it would be upstairs in the attic in a box, collecting dust.

 

All this bill will do is drive history (Purple Hearts) out of the country and into European auction houses, much like what happened with the Medal of Honor a few years ago. Those collectors that choose to continue buying/selling/trading Purple Hearts will become criminals for protecting history. We cannot allow this to happen.

So I was thinking about this... Do you think there will be a rash of selling/buying/preserving of hearts right before the law tries to go into effect? If I'm not mistaken, there is usually a "grace period" between the time a law is signed and when it takes effect? Yes?

There will be a rash of Purple Hearts being traded/sold to collectors/dealers overseas. The Liverpool Medal company will have hundreds of named Purple Hearts on their site much like when they had something like 14 MOH's when those became "toxic." A pathetic thing indeed.
